Plaey, Inc., (“Plaey,” “we,” or “us”) respects your privacy. We are committed to protecting the privacy of our users and we want to provide a safe and secure user experience. We will use our best efforts to ensure that the information You submit to us (including any “Feedback”, as such term is defined in our Terms of Service) remains private and is used only for the purposes set forth herein. This policy details how data about You is collected, used, and shared when You access our Platforms and Services or interact with us (collectively, the “Plaey Services”).

1. Applicability of Privacy Policy

This privacy policy applies to all information we collect through our Platforms and mobile applications (the “Plaey Services”) from current and former Plaey users and visitors. When You are no longer a registered user, we continue to share your information as described in this policy. This policy also covers our treatment of any personally identifiable information that our business partners share with us.

2. Information Collected

We collect or receive personal information in a few different ways via Platform. Often, you choose what information to provide, but sometimes we require certain information in order for you to use, and for us to provide you with, Platform and the Experiences you book or access through Platform.

Data You Provide To Us.

There are a variety of different ways you may provide data to us, such as:

  • Account Creation. To create an account, you need to provide data including information such as your name, email address, phone number, sign-up city and a password. If you make a purchase or sign up for a subscription, you will need to provide payment and billing information. You can choose to add further information to your account, such as birthdate, gender, photo and address.
  • Profile. To complete your profile, you may provide other information, such as a photo or birthdate.
  • Posting and Uploading. We collect personal information from you when you provide, post or upload it to our Platform, such as when you respond to a survey or provide an Experience rating or review.
  • Third Party Data. You may not provide information to us about someone else unless you have obtained the prior consent of the other person for us to receive and use their information, such as for emergency contact or referral purposes.

Data Collected Automatically Through Your Use of Platform.

  • We log usage data when you visit or otherwise use our Platform, such as when you view or click on content or ads (on or off our Platform), perform a search, browse, schedule a reservation and install or update one of our mobile apps. Specifically, the information we collect automatically may include information like internet protocol (“IP”) address, device type, unique device identification numbers, browser-type, broad geographic location (e.g. country or city-level location), language and marketing preferences and other technical information. We may also collect information about how your device has interacted with our Platform, including the pages accessed and links clicked.
  • Do Not Track (“DNT”) is an optional browser setting that allows You to express your preferences regarding tracking by advertisers and other third parties. Plaey does not track its users over time and across third party Platforms to provide targeted advertising and therefore does not respond to DNT signals.
  • We may also collect precise geolocation data pertaining to your mobile device, if you have consented to providing this to us through your device settings. We may use this information to provide, promote, and improve our services (for example, by showing you Experiences that are close to your location) and for related reasons, such as fraud prevention and security purposes. Please note that if you do not consent to providing your geolocation data, certain features of the mobile application may not work.
  • We use analytics providers such as Google Analytics, which use cookies and similar technologies to collect and analyze information about use of Platform and report on activities and trends. The services may also collect information regarding the use of other Platforms, apps and online resources. You can learn about Google’s practices by going to https://www.google.com/policies/privacy/partners/,  and opt out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout.

Data Collected When You Connect To A Third Party Network.

  • Where we make this available, you may choose to sync your account details with a third party network, such as Facebook. If you do this, we will receive some of your Facebook account information. Exactly what information we receive will depend on your settings with the third party network, but typically we receive your basic public profile information such as your username, email address, age range, gender, chosen language, country, friends list and any other public information.

3. How Plaey Uses Personal Information

Plaey uses personal information it receives for several purposes:

  • Platform: To operate and maintain our Platform and Services offered through our Platform. For example, we use personal information to fulfill your reservation and purchase requests, including processing payments, and to customize your experience on our Platform, such as by tailoring the content or Experiences we show you.
  • Communication: To contact you through email, phone, postal mail, notices and/or push notifications posted on our Platform, and other ways. We will send you messages about the availability of our Platform, security, customer service, or other service-related issues. We also send messages about the Platform, updates, reminders, and promotional messages in accordance with your communications preferences. You may change your communication preferences at any time. Please be aware that you cannot opt-out of receiving service messages from us, including security and legal notices.
  • Customer Support: In connection with customer service inquiries and matters, such as to investigate, respond to and resolve complaints and service issues.
  • Marketing: For marketing purposes, such as to develop our marketing strategy and offer contests, sweepstakes, or other promotions and to fulfill any related awards or discounts.
  • Research and Development: For research, analytical, recordkeeping, and reporting purposes; to develop and test new products, features and ideas; to learn about our customer base and Platform and to evolve and improve our Platform and Services.
  • Security and Investigations: We use your information to maintain the security of our Platform, including to verify your identity, to investigate or prevent possible fraud or other violations of our Terms of Use or this Privacy Notice and/or in connection with possible attempts to harm our members, visitors, studio partners or other third parties.
  • Other: For any other purpose identified at the point of collection or otherwise with your consent.

4. Platform Visitors

We gather information about all registered and unregistered users collectively, such as which services users access the most. We only use such data anonymously. This information helps us determine what is the most beneficial for our users and how we can create a better overall user experience. We may share anonymized information with our partners so that they may also understand how users and visitors use Plaey Services. We may use data stitching to aggregate combine datasets with datasets from multiple sources, to better track use of our services.

We use Google Analytics to better understand how You use the Services.  If You are logged into Google services at the time you access the Services then demographical information from your Google profile may be provided to use via Google Analytics. 5. Information from Minors

We do not knowingly solicit, collect, or share information from any individuals under the age of 18.

6. Sharing Information

We may disclose your personal information to the following categories of recipients or in the following circumstances:

  • Third party services providers and partners who provide data processing and other services to us (for example, to support the delivery of, provide functionality on, or help to enhance the security of our Platform, payment card processors, customer support vendors, hosting vendors, scheduling providers and market research and marketing vendors), or who otherwise process personal information for purposes that are described in this Privacy Policy or notified to you when we collect your personal information.
  • To our group companies, to provide, develop, improve, and analyze the Platform and our offerings.
  • To any Venue, studio, instructor or other provider that makes available an Experience, you book or use through our Platform and their third-party providers, so that they can process the applicable reservation or activity and make available Experiences and Services to you.
  • If you sync your account to a third party network, such as Facebook, or provide us with your contacts, such as those stored on your mobile device, you will be able to see which of your contacts are using Plaey. If those contacts are Plaey members, they will also be able to see that you are using Plaey.
  • Your name, photo and other general profile information associated with your account will be visible to other Plaey members so that they can search for and connect with you on Plaey. You can prevent other users from being able to search for you by updating your preferences via the Privacy tab in your Account Settings.
  • To anyone who visits our Platform if you share information about yourself in a public area on our Platform, such as in your public profile, a review or an Experience rating. You should be aware that any content or information you choose to disclose in these areas can be read, collected and used by other users, the general public and other sites (including search engines).
  • To any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary as a matter of applicable law or regulation, to exercise, establish or defend our legal rights, or to protect your vital interests or those of any other person.
  • To any other person with your consent to the disclosure or otherwise in accordance with applicable law.
  • In the event of a merger, reorganization, dissolution or similar corporate event, or the sale of all or substantially all of our assets, we expect that the information that we have collected, including, without limitation, personal information, would be transferred to the surviving entity in a merger or the acquiring entity.  If we are involved in a merger, acquisition or asset sale, or in the unlikely event of a bankruptcy, liquidation or receivership of our business, and your personal information becomes subject to a different privacy policy, we will provide affected users notice through the Plaey Services.

7. Protection and Storage of Personal Information

Your personal information is protected by physical, electronic, and procedural safeguards in compliance with applicable U.S. federal and state regulations. We also use computer safeguards such as firewalls and data encryption. For example, as noted above, we and our credit card processor service providers use SSL encryption to safeguard your credit card data when used in online transactions. In addition, we enforce physical access controls to our offices and files, and we do not authorize access to users’ personal information except for those personnel who require such access to fulfill their job responsibilities. Despite our efforts to ensure security, we cannot guarantee that personal information may not be accessed, disclosed, altered, or destroyed by breach of our administrative, managerial, and technical safeguards. Therefore, we urge you to take adequate precautions to protect your personal data as well, including, without limitation, never sharing the username and password used in connection with your participation in the Plaey Services. If we learn of a system security breach, we may attempt to notify you electronically. By using the Plaey Services, you agree that we may communicate with you electronically. Plaey may post a notice on its Platform(s), mobile application(s), and/or other services if a security breach occurs. We may also send an email to you at the email address you have provided to us. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice of a security breach) you should notify us of your request by emailing us at hello@plaeyapp.com

8. Opt-out Choices, Notifications, and Retention of Information

Plaey provides you with the opportunity to opt out of receiving certain types of communications. If you no longer want to receive notifications, change your preferences on your account settings or communicate your preferences to us via email at hello@plaeyapp.com. You may opt out of receiving promotional communications from us by following the instructions in those communications. If you do opt out, we may still send you non-promotional communications, such as information about your account or your use of the Plaey Services.

With your consent, we may send promotional and non-promotional push notifications or alerts to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.

If you deactivate your account or request that Plaey delete your personal information, we may still retain certain data and information associated with your account for analytical purposes and record-keeping integrity, as well as to prevent fraud, collect any fees owed, enforce our terms and conditions, take actions we deem necessary to protect the integrity of our Platform or our users, or take other actions otherwise permitted by U.S. and federal law. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

9. California Privacy Rights

Residents in California (and other states where required by law) have certain rights with respect to the personal information collected by businesses. If you are a resident of any such state, you may exercise the following rights regarding your personal information, subject to certain exceptions and limitations:

  • For certain categories of personal information, the right to request a list of what personal information (if any) we disclosed to third parties for their own direct marketing purposes in the preceding calendar year and the names and addresses of those third parties;
  • The right to know the categories and specific pieces of personal information we collect, use, disclose, and sell about you, the categories of sources from which we collected your personal information, our purposes for collecting or selling your personal information, the categories of your personal information that we have either sold or disclosed for a business purpose, and the categories of third parties with which we have shared personal information;
  • The right to request that we delete the personal information we have collected from you or maintain about you;
  • The right to opt out of our sale(s) of your personal information (if any); and
  • the right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CCPA.

You may designate an authorized agent to make a request on your behalf. You can do this by authorizing your agent to access your Plaey account and making a request on your behalf by contacting us at hello@plaeyapp.com. We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.

10. Modifications

We may update this Privacy Policy from time to time. We will place any updates to this Privacy Policy on our Platform at http://www.plaeyapp.com/privacypolicy. You may also request a paper copy of the Privacy Policy by contacting us at the email or address noted below. You are bound by any changes to the Privacy Policy by using the Plaey Services after such changes have been posted.
